7:00pm – BUDGET WORKSHOP

City Manager Gregg Guetschow introduced Finance Director Richard Williams.  Mr. Williams commented regarding the budget process.  There was general council discussion regarding the proposed 1% administrative fee, areas of the budget where money could be taken to offset losses, revenue sharing projections and property taxes.

APPROVE MINUTES – REGULAR MEETING OF MAY 3, 2004

Motion by Councilperson Ford to approve the Minutes of the Regular Meeting of May 3, 2004 as presented.  Motion supported by Mayor Pro-Tem Osika and concurred in by unanimous vote.

PROCLAMATIONS / SPECIAL PRESENTATIONS

Proclamation– Relay for Life Days

Mayor Davis presented a proclamation to Cathy Stevenson, Memorial Healthcare Center Community Resources Liaison, declaring May 21 & 22, 2004 as Relay for Life Days in the City of Owosso as follows:

A PROCLAMATION
OF THE MAYOR’S OFFICE OF THE CITY OF OWOSSO, MICHIGAN
DESIGNATING MAY 21 & 22, 2004 AS
“RELAY FOR LIFE” DAYS IN THE CITY OF OWOSSO

WHEREAS,       “Relay for Life” is the American Cancer Society’s signature event developed to make a difference in the fight against cancer; and 

WHEREAS,       “Relay for Life” is designed to bring the community together to benefit cancer research and education programs and services; and 

WHEREAS,       the Mayor’s Office of the City of Owosso is desirous of joining the sponsors in their campaign to raise funds in our community by encouraging people to participate in “Relay for Life” activities on Friday, May 21st and Saturday, May 22nd, 2004 at the Shiawassee Fairgrounds.

NOW, THEREFORE, I, John C.M. Davis, Mayor of the City of Owosso, Michigan, do hereby proclaim MAY 21 & 22, 2004 as “RELAY FOR LIFE” Days in the City of Owosso, Michigan and further encourage all citizens of this community to become involved with this valuable lifesaving program.

 

Meritorious Service Awards 

Police Chief Michael T. Compeau presented Crossing Guard Loretta DeVoe with the following Certificate of Appreciation Award: 

On the morning of February 24, 2004 School Crossing Guard Loretta DeVoe was on duty at her corner of Corunna Avenue and Woodlawn where she was attending to her duties as a crossing guard.  While thus occupied, she noticed some suspicious activity nearby.  Specifically, she observed a subject breaking into a nearby residence through the basement window.  Ms. DeVoe noted what the suspect was wearing (in great detail), what he took, where he came from, and where he went. 

Ms. DeVoe phone 911 using the cell phone she was carrying and relayed this information to the Owosso Police Department.  Because of Ms. DeVoe’s keen observation skills and timely action, the Owosso Police Department was able to apprehend the suspect and recover the stolen property. 

The suspect has been charged with Home Invasion and is awaiting trial on this charge.

Ms. DeVoe was instrumental in the apprehension of this suspect for Home Invasion, and for her actions is awarded a Certificate of Appreciation from the Owosso Police Department. 

Police Chief Compeau presented Police Officer Kevin Pettigrew with the following Citation of Professional Excellence: 

Click here to return to the top of the page.On April 30th, 2004 at 10:30pm Officer Kevin Pettigrew was dispatched to the parking lot behind the Sportsman’s Bar on W. Main St. for a fight in progress.  Upon Officer Pettigrew arrival he did not observe a fight, but did observe two subjects one was seated in a vehicle the other subject quickly entered the same vehicle upon seeing Officer Pettigrew’s arrival.  Officer Pettigrew approached these two subjects and inquired if the two had seen a fight in the parking lot.  While talking with the subjects Officer Pettigrew noted the individual that was seated in the drivers seat was possibly intoxicated, and suggested that this subject walk home and not operate a vehicle.  When the subject stepped from the vehicle Officer Pettigrew noticed a brown object protruding from the subjects rear pocket.  Officer Pettigrew recognized this as a handgun and quickly seized the gun. The subject admitted to Officer Pettigrew that he was carrying the gun illegally because someone had threatened to kill him.  The subject was arrested and is awaiting trial for carrying a Concealed Weapon. 

Because of Officer Pettigrew keen observation skills and thoroughness he prevented possible injury to himself and others.   

For his actions the Owosso Police Department would like to recognize Officer Kevin Pettigrew with a Citation of Professional Excellence for this outstanding work. 

Police Chief Compeau presented Police Officer Rusty LaMay with the following Citation for Meritorious Service: 

On April 16, 2004 Officer Rusty LaMay was on patrol at about 2:30am. When he observed a blue Cadillac driving south on Washington Street at a high rate of speed, this vehicle ran the stop sign at Washington and Comstock Streets.  Officer LaMay pulled behind the vehicle and activated his emergency lights; the Cadillac accelerated its speed and attempted to elude Officer LaMay.  The Cadillac traveled only a short distance when it skidded out of control striking a tree, a large rock and a telephone pole.  Upon the vehicle coming to a stop four suspects fled from the vehicle and into a wooded area.  Officer LaMay was able to determine that this was a stolen vehicle; Officer LaMay quickly radioed dispatch with a description and direction of travel of the suspects.  Other officers set up a perimeter around the area.  After a six-hour search all four suspects were arrested.  Officer LaMay was able to gather evidence from the scene, which linked the four suspects to another stolen vehicle recovered in the City of Owosso later this same day.

Two of the suspects are currently in the County Jail awaiting trial on two counts of Auto Theft, the two other suspects have been petitioned to Probate Court for two counts of Auto Theft. 

Because of diligence and perseverance, Officer LaMay performed a difficult task under unusual circumstances that resulted in four suspects being arrested for a serious felony. 

For his action Officer Rusty LaMay is awarded a Citation for Meritorious Service from the Owosso Police Department.

 

Presentation regarding proposed Rain Street Development

City Assessor Larry Cook introduced the project that city staff has been working on in recent months for the development of city-owned property on Rain Street.  The project is proposed as a joint partnership between the City of Owosso and the Shiawassee County Habitat for Humanity.  Mr. Cook introduced Pastor Jim Downing, Director of Shiawassee County Habitat for Humanity.  Pastor Downing addressed the City Council regarding the proposed project. 

Councilperson Owen commented that the notice for the neighborhood meeting regarding the proposal had caused “quite a stir in the neighborhood”.  He expressed concerns with the timing of the notice; loss of open space in the neighborhood; the concentration of Habitat homes; being known as a “Habitat community”; the amount of neighborhood input; and other options that would not change the outline of the neighborhood.  Councilperson Owen reported that he was asked to submit a petition from residents in the vicinity of the proposed project in opposition to the proposal.  He submitted the petition to the City Clerk

Mr. Cook commented that staff is looking for ways to increase the tax base.  City Manager Guetschow commented regarding past plans for the property and working within the time schedule required by Habitat.  Councilperson Horvath inquired if there were any plans for the property to the north and the west.  Gary Burk, Utilities Director, commented regarding the adjacent drain and proposed use for storm water retention and management. 

PUBLIC HEARING
ORDINANCE AMENDMENT
PARKS AND RECREATION COMMISSION ORDINANCE
 

ORDINANCE NO. 657

A public hearing was conducted to receive citizen comment regarding the proposed repeal of Chapter 2, Administration, Article IV, Boards and Commissions, Division 3, Parks and Recreation Commission.

Mike Norton, 710 Lynn Street, commented in support of the commission.

Whereas, the City Council, after due and legal notice, has met and having heard all interested persons, motion by Mayor Pro-Tem Osika that the following Ordinance be adopted:

 

ORDINANCE NO. 657

AN ORDINANCE TO REPEAL CHAPTER 2, ADMINISTRATION, ARTICLE IV, BOARDS AND COMMISSIONS, DIVISION 3, PARKS AND RECREATION COMMISSION, OF THE CODE OF THE CITY OF OWOSSO, MICHIGAN.

THE CITY OF OWOSSO ORDAINS:

Section 1.  Division 3, Parks and Recreation Commission, of Article IV, Boards and Commissions, of Chapter 2, Administration, of the Code of Ordinances of the City of Owosso, Michigan shall be and the same is hereby repealed.

Section 2.        This ordinance shall take effect June 6, 2004.

Section 3.        This ordinance may be purchased or inspected in the City Clerk’s office Monday through Friday between the hours of 9:00 a.m. and 5:00 p.m.         

Motion supported by Councilperson Ford.

CITIZEN COMMENTS

Mike Norton, 710 Lynn Street, addressed the City Council regarding revenue, taxes, making landlords accountable for maintenance of their property, and looking at the Habitat program as a “hand-up” instead of a “handout”.

Russ Hill, 735 Coventry Court, commented in opposition to the Rain Street development proposal.

Betty Coon, 1204 Palmer Street, commented in opposition to the proposed 1% administrative fee.

Joe Borgstrom, Shiawassee Economic Development Partnership Director, distributed copies of “marketing materials” and commented regarding the status of work done for countywide economic development.

Councilperson Owen inquired regarding the status of the grant for the Owosso Hotel demolition.  Councilperson Sumrack inquired regarding the city’s liability.  Philip Hathaway, Director of Community Development, responded to the inquiries.

 

CONSENT AGENDA

Motion by Councilperson Ford to approve the Consent Agenda as follows:

Planning Commission Referral-Preliminary Plat.  Referred preliminary plat for the Rain Street Development to the Planning Commission.

Contract Payment.  Authorized Progress Payment No. 1 to Perrin Construction, Inc. for work performed on the Michigan Avenue reconstruction project in the amount of $48,053.25.

Contract Payment.  Authorized Progress Payment No. 18 to J.R. Heineman & Sons, Inc. for work performed through April 30, 2004 on the Water Treatment Plant Improvement Project in the amount of $31,590.00.

Bid Award.  Accepted bid from Signature Ford for one (1) 4x4 ¾ ton pick-up in the amount of $17,473.00.

Bid Award.  Accepted bid from Signature Ford for four (4) 4x2 ¾ ton pick-ups in the amount of $14,961.00 each.

Bid Rejection.  Rejected bid for Asphalt Pad for the Skate Park relocation in the amount of $9,162.75 from Saginaw Asphalt Paving.

Traffic Control Order No. 1134.  Authorized Traffic Control Order No. 1134 to allow No Parking on the east side of Water Street between Oliver Street and Exchange Street from June 10, 2004 to October 3, 2004.

Traffic Control Order No. 1135.  Authorized Traffic Control Order No. 1135 to allow left turns on southbound North Shiawassee Street (M52) at Oliver Street from June 10, 2004 to October 3, 2004.

CITY BUDGET ADOPTION

Motion by Councilperson Horvath to adopt the following General Appropriations Resolution:

WHEREAS, pursuant to Chapter 8, Section 5 of the Owosso City Charter, the City Council has received the proposed budget for the fiscal year beginning July 1, 2004 and held a public hearing on May 3, 2004; and

WHEREAS, it is the intent of the City Council to levy property taxes for general operating purposes of the City and for payment of principal and interest on indebtedness, based on the budget summary for fiscal year 2004-2005 attached hereto and made part of this resolution; and

WHEREAS, the general property tax laws, specifically, MCL 211.34(d) provide for a compound millage reduction calculation applied to the City Charter maximum authorized operating millage rate of fifteen mills per thousand of taxable value; and

WHEREAS, this millage reduction commonly known as the “Headlee” rollback results in a maximum operating millage rate of 13.1170 for which the City is authorized to levy; and

WHEREAS, it has been determined that a millage rate of .6466 mills is required for the annual debt service on outstanding unlimited general obligations bonds,

NOW, THEREFORE, BE IT RESOLVED, that the tax levy for the fiscal year commencing July 1, 2004 shall be the rate of 13.7636 per 1,000 of taxable value of the 2004 assessment roll as approved by the Board of Review; and 

The total levy shall be composed of the constituent rates for purposes and with revenue yields described as follows:

GAS & WEIGHT TAX TRANSFER RESOLUTION

Motion by Mayor Pro-Tem Osika to adopt the following Gas & Weight Tax Transfer Resolution:

WHEREAS, it has been determined that additional gas and weight tax revenues from the Major Street fund are required for the operation of the Local Street fund for the fiscal year 2004-05; and

WHEREAS, it is a requirement of Act 9 of 2004 which amends Act 51 of 1951 that a resolution be approved by the local governing body if more than twenty-five percent of the gas and weight tax revenues received by the Major Street fund are transferred to the Local Street fund; and

WHEREAS, it is also a requirement of the Act for the additional transfer that the Local Streets be identified; the amount of the additional transfer be indicated; an asset management process be followed; and that confirmation be given to the State that the Major Streets are being properly maintained;

 

NOW, THEREFORE, BE IT RESOLVED, the City Council affirms that the Major Streets of the City are being properly maintained; that an asset management process is in place, and that a list of the Local Streets being funded is attached hereto and made part of this resolution authorizing the additional transfer of $48,200 to the Local Street fund.

DOWNTOWN DEVELOPMENT AUTHORITY GENERAL APPROPRIATIONS RESOLUTION

Motion by Councilperson Robertson to adopt the General Appropriations Resolution to authorize the levy of the Downtown Development Authority millage for the 2004-2005 fiscal year as follows:

GENERAL APPROPRIATIONS RESOLUTION FOR
DOWNTOWN DEVELOPMENT AUTHORITY

WHEREAS, the Authority board met to consider a proposed budget for fiscal year 2004-05, and after deliberations and public input approved a budget; and

WHEREAS, the Owosso City Council held a public hearing on the proposed budget on May 3, 2004; and

WHEREAS, it is the intent of the Downtown Development Authority to levy a tax for general operating purposes pursuant to Public Act 197 of 1975 based on the budget summary attached hereto and made part of this resolution; and

WHEREAS, the general property tax laws, specifically MCL 211.34(d) provide for an annual compound millage reduction calculation applied to the maximum millage rate of two mills pursuant to MCL 125.1662; and

WHEREAS, the millage reduction commonly known as the “Headlee” rollback results in a maximum operating millage rate of 1.9623 for which the Authority is authorized to levy,

NOW, THEREFORE, BE IT RESOLVED, that the tax levy for the fiscal year commencing July 1, 2004 shall be the rate of 1.9623 per $1,000 of taxable value of the 2004 ad valorem assessment roll for the district as approved by the Board of Review,

The levy will generate a revenue yield for operating purposes as follows:

Gary Burk, Utilities Director, addressed the City Council regarding communications with representatives from Wal-Mart and Caledonia Township officials related to a request for city water service.  He reported that a response from Wal-Mart representatives regarding a proposed agreement had not been received.

Motion by Councilperson Owen to postpone consideration of a proposed agreement until such time as the required information is received from Wal-Mart representatives.

Motion supported by Councilperson Sumrack.

CONTRACT AGREEMENT

Motion by Councilperson Owen to authorize a Contract Agreement with Layne Northern Co. for well cleaning and pump inspection for Palmer Well No. 3 in the amount of $14,612.00.

LIQUOR LICENSE TRANSFER REQUEST

Motion by Mayor Pro-Tem Osika that the request from Trecha Enterprises, LLC to transfer ownership of 2003 Class C licensed business, located at 217-219-223 South Washington Street, Owosso, MI 48867, Shiawassee County, from VEI-Capital Bar, Inc. be considered for approval.

Motion supported by Councilperson Owen.

FIFTH MONDAY MEETING

There was discussion related to an agenda for a Fifth Monday meeting.  Councilperson Horvath suggested discussion related to rotation of the members for roll call votes and street closure requests from individuals.  City Manager Gregg Guetschow and City Attorney William Brown commented that the City cannot regulate activities based on their content.  City Manager Guetschow advised Council that if the issue became a problem that staff would present proposals to Council to address the matter.  He also asked the City Clerk to research how other communities handle roll call voting.  No action was taken to schedule a Fifth Monday meeting.

 

BID AWARD

Councilperson Horvath expressed concern with the wide spread in the individual bid amounts.  Gary Burk, Utilities Contractor, commented regarding bidding procedures used by contractors.

Motion by Councilperson Horvath to accept low bid from Barnhardt & Son, Inc. for Infrastructure installation in Phase I of the Osburn Lakes Single Family Subdivision Project in the amount of $537,137.75.

Motion supported by Councilperson Robertson.

CHANGE ORDER

Councilperson Sumrack questioned Item No. 5 of the Change Order regarding the installation of a P-trap for the pH probe.  Gary Burk, Utilities Director, commented that it wasn’t required for standard operation but found to be necessary when sample flow is interrupted.

Motion by Councilperson Sumrack to authorize Change Order No. 8 to the contract with J.R. Heineman & Sons, Inc. for additional work done on the Water Treatment Plant Improvement Project in the amount of $4,048.35.

Motion supported by Councilperson Owen.

CITIZEN COMMENTS

Betty Coon, 1204 Palmer Street, thanked the council members who did not support the 1% administrative fee.  She also commented regarding the burning ordinance.

Terry Carriveau, 114 North Howell Street, commented that Owosso is a depressed community and people are not making large salaries.  He also commented regarding paying for drain projects, SATA millage, and the recent Car Show.

Shelva Cebulski, 1243 Marion Street, inquired about the dates for bridge construction on the M-52 and Oliver Street bridges.  She was advised that there is no work scheduled for the Oliver Street Bridge.

Councilperson Horvath inquired about the Owosso Drain settlement.  City Attorney Brown responded to his inquiry.  There was general discussion regarding settlement of the remaining appeals (lawsuits), moving forward with the Owosso Drain Project, and the potential for redrawing of the flood plain boundaries.

Mrs. Coon asked for an answer regarding her burning question.  City Manager Guetschow responded.

 

ADJOURNMENT

Motion by Councilperson Ford for adjournment at 9:25 p.m., supported by Councilperson Robertson and concurred in by unanimous vote.
