APPROVAL OF THE MINUTES OF REGULAR MEETING OF SEPTEMBER 7, 2004:

ADDRESSING THE CITY COUNCIL

1.   Your comments shall be made during times set aside for that purpose.

2.   Stand or raise a hand to indicate that you wish to speak.

3.   When recognized, give your name and address and direct your comments to the Mayor.

4.   Each person wishing to address the City Council shall be afforded one opportunity of up to two (2) minutes duration during each occasion for citizen comment and during each public hearing.  Comments made during public hearings shall be relevant to the subject for which the public hearings are held.

CONSENT AGENDA

1.   Bid Award.  Pursuant to Section 2-345 (3) waive competitive bidding procedures and authorize the factory repair of the water department’s Mueller C1-36 water main drill/tap machine by The Mueller Co. in an amount not to exceed $8,000.00.

2.   Bid Award.  Accept low bid from Davenport Masonry for repair work to the Curwood Castle chimney in the amount of $10,584.00.

3.   Contract Payment.  Authorize Progress Payment No. 2 to Constine Inc. in the amount of $25,294.57 for work completed on the 2004 Street Program.

4.   Contract Payment.  Authorize Progress Payment No. 7 to Barnhart & Son in the amount of $56,159.26 for work completed on Phase One, Osburn Lakes Site Condominium Project Infrastructure Installation.

5.   Change Order.  Authorize Change Order No. 1 with Barnhart & Son for installation of 13 utility crossings in the Osburn Lakes Site Condominium Project in the amount of $5,200.00.

6.   Discharge of Rental Rehabilitation Property Mortgage. Authorize Discharge of Rental Rehabilitation Property Mortgage as it relates to 221 Cass Street (James A. and Gail C. Near) and further authorize the Mayor and City Clerk to execute appropriate documents.

7.   Discharge of Rental Rehabilitation Property Mortgage. Authorize Discharge of Rental Rehabilitation Property Mortgage as it relates to 1436 Donald Street (John A. and Jane M. Chrenka) and further authorize the Mayor and City Clerk to execute appropriate documents.

8.   Warrant No. 300.  Accept Warrant No. 300 as presented.

ITEMS OF BUSINESS

1.   MAGNET Grant Award.  Consider acceptance of a grant award for the MAGNET drug team from the State of Michigan Department of Community Health Office of Drug Control Policy in the amount of $44,500.00, with matching funds of $44,500.00, and authorize the Mayor and City Clerk to execute necessary documents.

2.   Electrical Service Agreement.  Consider service agreement with Consumers Energy to provide power to the Osburn Lakes Residential Subdivision Lift Station.

3.   Purchase Agreement.  Authorize Purchase Agreement with Open Software Solutions Incorporated for software for the Public Safety Department, Police Division and approve 1st installment payment of  $35,796.00.

4.   Truck Route Change.  Consider request from Main Beverage to allow the use of South Cedar Street as a truck route (Traffic Control Order # 1138).
