APPROVAL OF THE MINUTES OF REGULAR MEETING OF SEPTEMBER 20, 2004:

ADDRESSING THE CITY COUNCIL

1.      Your comments shall be made during times set aside for that purpose.

2.      Stand or raise a hand to indicate that you wish to speak.

3.      When recognized, give your name and address and direct your comments to the Mayor.

4.      Each person wishing to address the City Council shall be afforded one opportunity of up to two (2) minutes duration during each occasion for citizen comment and during each public hearing.  Comments made during public hearings shall be relevant to the subject for which the public hearings are held.

PUBLIC HEARINGS

1.         Conduct Public Hearing-Rezoning Request.  Conduct public hearing to receive citizen comment regarding request to rezone the parcel(s) commonly known as 1216 West Main Street, and described as follows: COMM ON THE N LN OF MAIN ST 178' W OF E LN SEC 14 TH N 11' TO POB TH CONT N'LY 273' TH W'LY 136' TH S'LY ALG CENTER LN CHIPMAN CRK SEWER 174.5' TO A PT 106' N & PAR W/N LN MAIN STREET TH E'LY ALG SD LN 18.80' TH S 106' TH E'LY TO POB from B-4 General Business District to OS-1 Office Service District.

2.         Conduct Public Hearing-Ordinance Amendment.  Conduct public hearing to receive citizen comment regarding proposed ordinance amendments to Chapter 26, SIGNS, Article III, Definitions, Section 26-9. Definitions and interpretation; Article IV, Specific Control Provisions, Section 26-23. Specific control provisions; and Article V, Schedule of Sign Regulations, Section 26-28. Number, dimensions, and location of individual signs by zoning district, Chart IV, of the Code of Ordinances of the City of Owosso, Michigan as it relates to subdivision identification signs.

3.         Conduct Public Hearing-Ordinance Amendment.  Conduct public hearing to receive citizen comment regarding proposed additions and amendments to Chapter 38, ZONING, as it relates to Planned Unit Development District and Regulations, of the Code of Ordinances of the City of Owosso, Michigan.

CONSENT AGENDA

1.         Change Order.  Authorize Change Order No. 1 increasing the amount of the bid award (purchase order) for concrete to Fisher Redi-Mix by $564.50 for additional concrete needed for the Public Works Salt Barn Project.

2.                Change Order.  Authorize Change Order No. 1 to Murin Company increasing the amount of the bid award for hydroseeding in the amount of $3,362.00 for work completed on Phase One, Osburn Lakes Site Condominium Project.

3.                Contract Payment.  Authorize Final Payment to Murin Company in the amount of $7,072.00 for for hydroseeding work completed on Phase One, Osburn Lakes Site Condominium Project.

4.                Contract Payment.  Authorize Progress Payment No. 1 to Highway Maintenance and Construction Company in the amount of $40,891.80 for work done on the 2004 Sealcoat and Slurry Seal Program.

5.                Contract Payment.   Authorize Progress Payment No. 9 to Barnhart and Son in the amount of $28,363.76 for work completed on Phase One, Osburn Lakes Site Condominium Project Infrastructure Installation.

6.                Contract Payment.  Authorize Progress Payment No. 4 to Constine, Inc. in the amount of $111,603.24 for work completed on the 2004 Street Program.

7.         Discharge of Rental Rehabilitation Property Mortgage. Authorize Discharge of Rental Rehabilitation Property Mortgage as it relates to 914 Corunna Avenue (Larry L. Judson, L. David Judson, and Carl E. Voorhies) and further authorize the Mayor and City Clerk to execute appropriate documents.

8.         Discharge of Mortgage and Assignment of Land Contract for Security Purposes. Authorize Discharge of Mortgage and Assignment of Land Contract for Security Purposes as it relates to 612-614 Adams Street (Barbara J. Fuoss) and further authorize the Mayor and City Clerk to execute appropriate documents.

9.         Discharge of Assignment of Land Contract to Secure Promissory Note.  Authorize Discharge of Assignment of Land Contract to Secure Promissory Note as it relates to 716 Corunna Avenue (William D. Smith and Kathy S. Smith) and further authorize the Mayor and City Clerk to execute appropriate documents.

10.       Discharge of Mortgage.  Authorize Discharge of Mortgage as it relates to 522 East Comstock Street (John K. Phillips and Mary E. Phillips) and further authorize the Mayor and City Clerk to execute appropriate documents.

11.       Boards and Commissions Appointment.  Approve Mayoral appointment of Janet L. Drews to the Owosso City Planning Commission to fill vacancy created by resignation of Jed Dingens for a term expiring 06-30-2006.

12.       Warrant No. 301.  Accept Warrant No. 301 as presented.

ITEMS OF BUSINESS

1.                Michigan Department of Transportation-State Trunk Line Maintenance Contract #2004-0701.  Authorize State Trunk Line Maintenance Contract with the Michigan Department of Transportation for the period October 1, 2004 through September 30, 2009 and further authorize the Mayor and City Clerk to execute the appropriate documents.

2.                Mid-County Wastewater Service Agreement-Proposed Amendment.  Authorize proposed amendment to the Mid-County Wastewater Service Agreement, conditioned upon the acceptance by Corunna and Caledonia and Owosso Townships and further authorize the Mayor and City Clerk to execute the appropriate document.

3.                Electric Line Extension Agreement-Consumers Energy.  Authorize Electric Line Extension Agreement with Consumers Energy to provide underground electrical service to the sanitary sewer lift station for Phase One, Osburn Lakes Site Condominium Project in the amount of $7,833.06 (This amount includes $2,175.00 for 150 feet of Underground Service and 50 Feet of Road Boring.
