APPROVE AGENDA

Motion by Mayor Pro-Tem Osika to approve the agenda as presented.  Motion supported by Councilperson Ford and concurred in by unanimous vote.

APPROVE MINUTES - REGULAR MEETING OF JANUARY 18, 2005

Motion by Councilperson Owen to approve the Minutes of the Regular Meeting of January 18, 2005 as presented.  Motion supported by Councilperson Robertson and concurred in by unanimous vote.

APPROVE MINUTES - SPECIAL MEETING OF JANUARY 31, 2005

Motion by Councilperson Ford to approve the Minutes of the Special Meeting of January 31, 2005 as presented.  Motion supported by Councilperson Robertson and concurred in by unanimous vote.

MAYOR DAVIS READ THE RULES FOR ADDRESSING THE CITY COUNCIL.

CITIZEN COMMENTS

Carl Rossman commented regarding the upcoming CROP Walk on May 1, 2005 from 1:30 – 2:00 p.m.

Tom Klockziem, 221 South Cedar Street, addressed the City Council regarding the use of South Cedar Street by Main Beverage trucks.  He distributed a handout for the Council members highlighting their concerns and requests for reimbursement.  Mr. Klockziem requested that this issue be brought up for city council discussion.

Mayor Pro-Tem Osika asked that this issue be placed on the agenda for discussion at the next council meeting.  Councilperson Robertson supported this request.  A Main Beverage representative is to be invited to the meeting.

CONSENT AGENDA

Motion by Councilperson Ford to approve the Consent Agenda as follows:

Special Assessment District No. 2005-01.  Authorized Resolution No. 1 for Special Assessment District No. 2005-01 for Ada Street from Campbell Drive to the North end for street reconstruction as follows:

WHEREAS, the City Council of the City of Owosso deems it necessary to acquire and construct the following described improvement:

Ada Street from Campbell Drive to the North end

NOW, THEREFORE, BE IT RESOLVED THAT:

1.         The matter of making said public improvement is hereby referred to the City Manager, who shall prepare a report thereon, which shall include plans and detailed estimates of the cost thereof and a description of the special assessment district and such other pertinent information as will permit the City Council to decide the cost, extent and necessity of the public improvement and what proportion of the cost should be paid by the City at large.

2.                The City Manager shall present said report to the City Council when same has been prepared.

Special Assessment District No. 2005-02.  Authorized Resolution No. 1 for Special Assessment District No. 2005-02 for Broadway Avenue from Farr Avenue to Auburndale Avenue for street reconstruction as follows:

NOW, THEREFORE, BE IT RESOLVED THAT:

1.         The matter of making said public improvement is hereby referred to the City Manager, who shall prepare a report thereon, which shall include plans and detailed estimates of the cost thereof and a description of the special assessment district and such other pertinent information as will permit the City Council to decide the cost, extent and necessity of the public improvement and what proportion of the cost should be paid by the City at large.

2.                The City Manager shall present said report to the City Council when same has been prepared.

Special Assessment District No. 2005-01.  Authorized Resolution No. 2 for Special Assessment District No. 2005-01, setting Public Hearing for Monday, March 7, 2005 for Ada Street from Campbell Drive to the North end for street reconstruction as follows:

WHEREAS, the City Council has ordered the City Manager to prepare a report for public improvement, more particularly hereinafter described; and

Ada Street from Campbell Drive to the North end

WHEREAS, the City Manager prepared said report and the same has been filed with the City Council as required by the Special Assessment Ordinance of the City of Owosso and the Council has reviewed said report.

NOW, THEREFORE, BE IT RESOLVED THAT:

1.         The plans and estimate of cost and the report of the City Manager for said public improvement shall be filed in the office of the City Clerk and shall be available for public examination.

2.         The City Council hereby determines that the Public Improvement hereinafter set forth is necessary.

3.         The City Council hereby approves the estimate of cost of said public improvement to be $85,400.00 and determines that $28,295.41 thereof shall be paid by special assessment imposed on the lots and parcels of land more particularly hereinafter set forth, which lots and parcels of land are hereby designated to be all of the lots and parcels of land to be benefited by said improvements and determines that $57,104.59 of the cost thereof shall be paid by the City at large because of benefit to the City at large.

4.         The City Council hereby determines that the portion of the cost of said public improvement to be specially assessed shall be assessed in accordance with the benefits to be received.

5.         The City Council shall meet at the Owosso City Hall Council Chambers on Monday, March 7, 2005 for the purpose of hearing all persons to be affected by the proposed public improvement.

6.         The City Clerk is hereby directed to cause notice of the time and place of the hearing to be published once in The Argus Press, the official newspaper of the City of Owosso, not less than seven (7) days prior to the date of said hearing and shall further cause notice of said hearing to be sent by first class mail to each owner of property subject to assessment, as indicated by the records in the City Assessor's Office as shown on the general tax roll of the City, at least (10) full days before the time of said hearing, said notice to be mailed to the addresses shown on said general tax rolls of the City.

7.         The notice of said hearing to be published and mailed shall be in substantially the following form:

4.         The City Council hereby determines that the portion of the cost of said public improvement to be specially assessed shall be assessed in accordance with the benefits to be received.

5.         The City Council shall meet at the Owosso City Hall Council Chambers on Monday, March 7, 2005 for the purpose of hearing all persons to be affected by the proposed public improvement.

4.         The City Council hereby determines that the portion of the cost of said public improvement to be specially assessed shall be assessed in accordance with the benefits to be received.

3.         The City Council hereby approves the estimate of cost of said public improvement to be $138,500.00 and determines that $56,757.25 thereof shall be paid by special assessment imposed on the lots and parcels of land more particularly hereinafter set forth, which lots and parcels of land are hereby designated to be all of the lots and parcels of land to be benefited by said improvements and determines that $81,742.75 of the cost thereof shall be paid by the City at large because of benefit to the City at large.

4.         The City Council hereby determines that the portion of the cost of said public improvement to be specially assessed shall be assessed in accordance with the benefits to be received.

5.         The City Council shall meet at the Owosso City Hall Council Chambers on Monday, March 7, 2005 for the purpose of hearing all persons to be affected by the proposed public improvement.

4.         The City Council hereby determines that the portion of the cost of said public improvement to be specially assessed shall be assessed in accordance with the benefits to be received.

Bid Award.  Accepted bid of Air Source One for an air compressor, a filling station, and 6 air storage systems in the amount of $26,250.00.

Purchase Authorization.  Authorized purchase of 10 Chairman Light fixtures from the Lighting Group in the amount of $15,560.00.

 

Change Order.  Authorized Change Order No. 10 with J.R. Heineman & Sons, Inc. for the deletion of work done on the Water Treatment Plant Improvement Project in the amount of $9,935.00 and an extension of the contract to January 28, 2005.

Contract Payment.  Authorized Final Payment to J.R. Heineman & Sons, Inc. in the amount of $235,073.45 for work done on the Water Treatment Plant Improvement Project.

Contract Payment.  Authorized Payment No. 3 to Sascon Incorporated in the amount of $35,226.90 for work done on the Elevator Installation Project at 104-108 North Washington Street.

Planning Commission Referral.  Referred to the Planning Commission a request from Baker College to revise the Master Plan for Collamer Park.

ITEMS OF BUSINESS

HISTORICAL COMMISSION BYLAWS

Motion by Councilperson Robertson to approve the proposed revisions to the Owosso Historical Commission Bylaws.

Motion supported by Councilperson Horvath.

There was general discussion regarding the reasoning behind the requested change and who would be paying the maintenance costs.  Councilperson Robertson withdrew her motion.  She also commented that if the issue is to be reconsidered that a member of the Historical Commission should be in attendance to answer questions.  No further action was taken.

PROPERTY SALE-Twenty-one (21) days posting period

Motion by Councilperson Ford to receive a proposal to transfer city-owned community center building at 300 North Washington Street legally described as Lot 11 in Block 11, of  the Plat of the Village (now City) of Owosso, in the County of Shiawassee, and State of Michigan, as to Parcel 1, and West 22 feet of the south 64 feet of Lot 12 Block 11, Original Plat of the Village (now City) of Owosso, in the County of Shiawassee, and State of Michigan, as to Parcel 2, for the sum of One and No/100 ($1.00) Dollar to Shiawassee Council on Aging and file with the City Clerk until the meeting of March 7, 2005.

Motion supported by Councilperson Owen.

CALEDONIA CHARTER TOWNSHIP PARTICIPATION WITH SATA

Motion by Councilperson Robertson to approve a resolution granting Caledonia Charter Township representation on the Shiawassee Area Transportation Agency board of directors as follows:

WHEREAS, Caledonia Charter Township took action at its December 20, 2004 meeting in support of joining the Shiawassee Area Transportation Agency (SATA) as per sections 3 and 4b of the agreement which formed SATA; and

WHEREAS, the SATA board of directors accepted said Township resolution at its January 11, meeting;

NOW, THEREFORE, BE IT RESOLVED, that the Owosso City Council concurs with both actions and welcomes Caledonia Charter Township and its representative, Ronald Sukenik, to the SATA board of directors, whose term shall expire on October 1, 2005.

Motion supported by Councilperson Owen.

There was general discussion regarding staff report concerning reestablishment of a rental inspection program.  Councilperson Robertson commented that she was disappointed that costs are too prohibitive to re-establish program.

CITIZEN COMMENTS

Eddie Urban, 601 Glenwood Avenue, commented regarding a family member who was relocated because of the fire in Westown.  He also commented that the Fire Inspection Program will be a good thing.

Tom Klockziem, 221 South Cedar Street, commented further regarding trucks using the street to cut through the residential area.  He requested additional police patrol.

Burton Fox, 216 East Oliver Street, commented regarding the need for a rental inspection program.
